Esgsystem.com is a website owned and operated by ESG System, otherwise referred to as “ESG System”. We are committed to protecting and respecting your privacy.

This agreement sets out the basis on which any data collected by esgsystem.com concerning you and your business, or that you provide to us, will be processed. Please read the following carefully to understand our practices regarding your personal data and that of your business and how it will be used.

By agreeing to these terms and conditions you are accepting and consenting to how esgsystem.com will process and use your data. Esgsystem.com are committed to complying with the GDPR (2016) and the Data Protection Act (2018) and good business practices. Esgsystem.com will always process your data in a fair and lawful way in accordance with article 5 and article 6 of the GDPR.

Esgsystem.com may collect and process the following data about you:

Esgsystem.com might need this information to provide you with the services that you have requested.

Esgsystem.com will never knowingly collect data from or on children below 16 years of age.

The parties shall comply with the SCC, as well as the terms of this Clause 4.3, in relation to any such transfers. For the purpose of the SCC, the data exporter shall be the party located in the EEA and the data importer shall be the party located outside the EEA.

The Customer agrees to be responsible for maintaining the confidentiality of its password and account details.

ESG System does not warrant that the Customer’s use of the Service will be uninterrupted or error-free and is not responsible for any, or any other loss or damage resulting from the transfer of data over communications networks and facilities, including the internet. The Customer acknowledges that the Service may be subject to limitations, delays and other problems inherent in the use of such communications facilities. ESG System shall have no liability (on any account) to the Customer as a result of or related to such events.

Data Breaches

ESG System takes all necessary precautions and have procedures in place to deal with any suspected data breaches and should this occur, will endeavour to notify you, your business as well as the relevant authorities as per any legal obligations.

Warranties and Limitations of Liability

Nothing in this clause or any other provision of this Agreement shall seek to exclude or limit liability for infringement, death, or personal injury or for breach of its obligation under s12 Sale of Goods Act 1979 or section 2 Supply of Goods and Services Act 1982 or fraudulent misrepresentation.

Whilst ESG System aims always to maintain a quality, fully operative Service, the Service and third-party Services are nonetheless provided on an “as is”, as available basis without warranties of any kind, whether express or implied.

Specifically, ESG System gives the Customer no warranty or assurance about the contents of the Service. Whilst ESG System does endeavour to maintain the accuracy and the quality of the Service, information contained may be incorrect or out of date. Therefore, any use of the Service is at the Customer’s own risk.

ESG System shall not be liable for any indirect or consequential loss. ESG System shall not be liable for the following types of financial loss (whether direct or indirect); loss of profits, loss of earnings, loss of business or goodwill in addition to the following types of anticipated or incidental losses; loss of anticipated savings, increase in bad debt and failure to reduce bad debt.

The data we hold about you

Should you wish to obtain a copy of the personal data that we hold about you, please send an email to info@esgsystem.com. As soon as we are satisfied with your identity, we will send you, within 40 days, a copy of all the data that we hold concerning you.

When you visit our company database web pages, tracking technologies may automatically record information about you. This information does not identify you personally. We automatically collect and store only the following information about your visit:

  • the internet domain and IP address from where you access our website.
  • the type of browser software and operating system you use to access our website.
  • the date and time you access our website.
  • the pages you enter, visit and exit on our web site; and
